Terms of Service — AlgarveFlow

These Terms of Service (“Terms”) govern your access to and use of the AlgarveFlow mobile application and website (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

“AlgarveFlow”, “we”, “our”, and “us” refer to the AlgarveFlow team/organization.

1) The Service

AlgarveFlow helps users discover, share, and manage information about events, venues, and organizers. The Service may include user accounts, saved/follow features, and notifications.

We may update, suspend, or discontinue features at any time, to the extent permitted by law.

2) Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you use the Service for an organization, you represent you are authorized to bind that organization.

3) Accounts and Security

  • Provide accurate registration information and keep it updated.
  • Keep credentials confidential and secure.
  • Accept responsibility for activity under your account.

If you suspect unauthorized access, contact info@algarveflow.pt immediately.

4) User Content

“User Content” includes listings, descriptions, media, links, comments, and other material you submit through the Service.

A) Your responsibilities

  • You own or have rights to submit the content.
  • The content does not violate third-party rights or law.
  • The content is not fraudulent, misleading, abusive, or harmful.

B) License to AlgarveFlow

You grant AlgarveFlow a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for formatting), display, and distribute User Content solely to operate and promote the Service.

This license ends when content/account is deleted, except for legal retention, abuse prevention, and limited-time backup systems.

C) Moderation and enforcement

We may review, remove, limit visibility, or restrict access to content/accounts where we reasonably believe Terms, law, or user safety is at risk.

5) Acceptable Use (Prohibited Behavior)

You agree not to:

  • access the Service by unauthorized means;
  • interfere with platform security, availability, or integrity;
  • automate scraping/crawling/harvesting at scale without written permission;
  • post spam, scams, malware, illegal content, or deceptive listings;
  • harass, threaten, impersonate, or abuse others;
  • violate applicable law or third-party rights.

6) Intellectual Property and Copyright Complaints

AlgarveFlow trademarks, software, design, and platform content (excluding User Content) are protected by intellectual property laws. If you believe your copyright is infringed, contact info@algarveflow.pt with sufficient detail for review.

7) In-App Purchases and Billing (if enabled)

If paid features are introduced, billing on iOS is handled by Apple and billing on Android is handled by Google. Payment processing, refunds, and subscription management are subject to the relevant store’s terms and policies.

We do not control Apple/Google billing operations and are not responsible for store payment failures or store-specific refund decisions.

8) Third-Party Services and Links

The Service may rely on third-party providers (authentication, hosting, analytics, notifications) and may link to external sites. Third-party services are governed by their own terms and policies.

9) Event Information Disclaimer

Listings may be created by users, organizers, venues, or partners. We do not guarantee the accuracy, completeness, legality, safety, or availability of listed events. Verify details directly with organizers before attending or purchasing.

10) Suspension and Termination

You may stop using the Service at any time. We may suspend/terminate access if:

  • you breach these Terms;
  • misuse, fraud, or abuse is suspected;
  • required for legal, trust, or security reasons.

We may act immediately where needed to protect users, partners, or the Service.

11) Apple-Specific Terms (iOS)

If you access the App on iOS, you acknowledge these Terms are between you and AlgarveFlow, not Apple. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple is not responsible for claims relating to the App, including product liability, legal compliance, or consumer claims.

12) Changes to these Terms

We may revise these Terms periodically. We will update the “Last updated” date and provide additional notice when required. Continued use after effective changes means you accept the revised Terms.

13) Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, secure, or error-free operation.

14) Limitation of Liability

To the maximum extent permitted by law:

  • AlgarveFlow is not liable for indirect, incidental, special, consequential, or punitive damages;
  • AlgarveFlow’s aggregate liability for Service-related claims will not exceed amounts paid by you to AlgarveFlow for the Service in the prior 12 months (or €10 if no payment was made).

Some jurisdictions do not allow certain limitations, so part of this section may not apply to you.

15) Governing Law

These Terms are governed by the laws of Portugal, excluding conflict-of-laws principles. Courts in Portugal have jurisdiction, except where mandatory consumer protection law provides otherwise.
